The Pension Reserve Fund, a public administrative institution created by Law No. 2001-624 of 17 July 2001, located at 56 rue de Lille – 75007 PARIS, complies with all applicable French and European laws and regulations on the protection of personal data. The FRR therefore applies a strict policy to ensure the protection of Personal Data:
- Personal data is processed in a transparent and secure manner, in accordance with individual rights.
- The FRR is committed to a continuous process of personal data protection in accordance with the amended French Data Protection Act of 6 January 1978 and the EU General Data Protection Regulation (GDPR) of 27 April 2016.
The General Data Protection Regulation
As of 25 May 2018, the GDPR will replace the current EU data protection regime established by the Data Protection Directive 95/46/EC (the Directive). Unlike the Directive, the GDPR will have direct effect throughout the EU. The scope of the GDPR is very broad and, although many of the principles of the Directive have been transposed into the GDPR, it also introduces a number of new provisions that will have a material impact on data controllers, processors and data subjects (as defined in the GDPR). In particular, it gives data subjects greater rights in terms of access, erasure and rectification.
This personal data protection policy describes the types of personal data (as defined in the GDPR) that the Pension Reserve Fund may collect and how it may use such data. This Policy may be amended, supplemented or updated in order to comply with any legislative, regulatory, jurisprudential or technical developments.
1. What Personal Data is processed?
The term ‘Personal Data’ refers to any information relating to an identified or identifiable natural person, directly or indirectly, by reference to an identification number or to one or more factors specific to that person. When the Pension Reserve Fund collects your Personal Data, this collection is carried out in a fair and transparent manner thanks to the presence of information notices on the exercise of your rights or references to this Policy.
Users are informed that their personal data collected through contact forms and newsletter registration forms is processed automatically by the FRR. The information collected is intended for members of the FRR’s Communications Department responsible for relations with Internet users. Certain specific information requested in the online forms is mandatory. Please note that if the information is entered incorrectly, it will not be sent to the FRR. If you do not wish to provide such information, you may not be able to access certain services or features of the Website. Other information is intended to help us get to know you better and is therefore optional.
2. What are the purposes of processing your Personal Data?
The FRR undertakes to collect Personal Data only for specific, explicit and legitimate purposes and to process it in accordance with the purposes set out:
- in this document. In this regard, it is specified that Personal Data may be collected and used for the purposes of processing the User’s request or registering for electronic newsletters, but also for statistical purposes;
- in the information notices relating to the forms and questionnaires published on the Website;
The FRR undertakes to process only Personal Data that is adequate, relevant and not excessive in relation to the purposes for which it is collected.
3. Who are the recipients and processors of your Personal Data?
Authorised FRR staff are recipients of your Personal Data.
The FRR may use processors (any company or legal entity required to process Personal Data in accordance with the FRR’s instructions) to process all or part of the Personal Data to the extent necessary to perform their services. These include the web agency and the website host. The FRR undertakes not to sell, rent or transfer your Personal Data to third parties without your consent.
The FRR may be required to disclose your Personal Data without your prior consent in order to comply with a legal requirement. As such, you agree that the FRR may transmit Personal Data if it deems it necessary to do so in order to comply with a court summons, warrant, judgment or order, or to a competent authority in the context of a specific investigation, and in particular for the defence of its rights.
4. How long do we keep your Personal Data?
The FRR processes and stores Personal Data in a secure environment for the time necessary to achieve the purposes for which it was collected.
This period may not exceed one (1) year, unless otherwise specified in the information notices relating to the forms and questionnaires published on the Website.
